A former appointee of Donald Trump was sentenced Friday to 70 months in prison for his violent role on January 6, 2021.

Federico Klein, a former State Department appointee, was found guilty following a bench trial before Judge Trevor McFadden this summer of multiple counts, including assaulting multiple police officers that day.

“Your actions on January 6 were shocking and egregious,” McFadden, also a Trump appointee, said during Friday’s sentencing.


According to the judge, Klein assaulted an officer during an initial breach on the Capitol grounds, telling the officer “you can’t stop us.”

McFadden also detailed several other assaults on officers from Klein, many of which occurred in the lower west terrace tunnel, one of the most violent scenes that day.

“This is a government of law, not of men,” McFadden said, adding that Klein had “betrayed your office.”

During Friday’s sentencing, former US Capitol Police Sgt. Aquilino Gonell told the court that Klein had attacked him multiple times with a police riot shield.

Gonell questioned how “someone who took the same oath as I did” to protect the Constitution, could be involved in such an assault on the Capitol.

Prosecutors also noted Klein – an ex-US Marine – had access to sensitive information with a security clearance at the State Department and suggested that in attacking the Capitol to keep Trump as President, Klein could have also been trying to keep his job as a political appointee.

Investigators found several images of Klein in the riot allegedly using a police riot shield to wedge open an entrance for rioters and fighting against a police line for several minutes, according to his arrest affidavit. Klein wore a red “Make America Great Again” hat then changed into a “United States Marine Corps” hat during the riot, investigators say.

Stanley Woodward, Klein’s attorney, said in court that Klein had not planned to attack the Capitol that day, adding that “no one person caused January 6.”

Woodward, who also represents Trump’s co-defendant Walt Nauta in the classified documents case in Florida, noted Klein had worked on Trump’s 2016 campaign.

Klein’s actions on January 6, Woodward said, were “not a betrayal” of his service in the military and the State Department, but was part of attending “a protest turned wrong.”

What is really disgusting about that lie is all the Capitol police that were injured died and committed suicides after the attack.

Judge Chutkan might have a better approach. She hinted the more Trump violated her gag order and tried to poison the jury pool with his lies and personal attacks the more she would push his trial date up. And she hasn't officially done that yet but this signals she's getting ready to. And that is a counter to Trump's mental illness. His brain is reptilian. He can only feel himself and his only instinct is to survive from one moment to the next. He can't bear to feel reality closing in on him so his natural instinct is to yell and scram and lie and attack and delay delay delay. So Judge Chutkan has him between a rock and a hard place. The more he attacks the faster reality comes to bear.

A decision by U.S. District Court for the District of Columbia Judge Tanya Chutkan to accelerate putting together a jury that will hear testimony in special counsel Jack Smith's 2020 election interference trial targeting Donald Trump is a signal to the former president that she has no intention of letting the proceedings drag out.

While Trump's legal teams doing everything they can to delay his multiple trials, Chutkan is swiftly addressing motions and, this week, moved the date up to create the jury that will hear the case she will preside over.

According to former prosecutor Glenn Kirschner, Chutkan, with the date change, is serving notice to the former president and his lawyers that she is not messing around.



Appearing on MSNBC on Saturday morning, the former prosecutor told host Jonathan Capehart, I have selected juries in big RICO cases in that very courthouse, and it's is a long and arduous process. What it looks like the judge is doing is bringing jurors in on February 9th. I think it's worth noting that all we knew previously that jury selection would begin on March 4th."

"She has now, in a sense, bumped it up almost a month and that really does give life to her statement in court that she made during the argument on the gag order that this trial will not yield to an election cycle," he explained. "It looks like she is determined to go full speed ahead and hold this trial in accordance with the trial schedule that she sets, which is unlike what we are seeing in Trump's documents, obstruction and espionage case down in Florida."

A decision by Donald Trump to appear as a witness for his own defense in the $250 million civil suit trial playing out in Judge Arthur Engoron's Manhattan courthouse could end up blowing up in the former president's face since the judge has already ruled he sees solid evidence of criminal fraud.

The current proceedings are being conducted in an effort for the judge to get his arms around the financial damages the Trump Organization will have to pay for allegedly defrauding banks and insurance companies. Engoron could also ban the involved Trump family members from doing business in the state of New York

Now Trump is expected to take the stand on Monday following last week's testimony by sons Don Jr. and Eric that legal experts asserted did not go well for the family.

With that in mind, former U.S. Attorney Joyce Vance suggested in her Substack column that Trump's decision to proceed with testifying could be a fatal error that could impact his trials in Washington D.C., Florida and Georgia.

As Vance noted, the way that Trump conducts himself while being grilled on Monday will give special counsel Jack Smith and Fulton County District Attorney Fani Willis a roadmap to be used when they get their shot at him on the stand in their respective trial.

According to Vance, "This is a civil, not a criminal case. No one goes to prison at the end of it. But the case is on track to put an end to the myth of Trump as a high flying, successful businessman. When Trump takes the witness stand, we’ll get a sense of whether he has the ability act in his own best interest with his back against the wall—Jack Smith and Fani Willis will undoubtedly be watching to see what kind of a witness he makes in his own defense."

Former President Donald Trump was forced to admit in court that he was not president in 2021 when he took control of a trust controlling his businesses.

The admission came while Trump was on the stand in his $250 million fraud trial in New York on Monday.

"Trump brings up the 2021 valuation of the joint venture, but says he wasn't really involved with it," Law360 crime reporter Stewart Bishop revealed. "Trump says he was very busy as president."



"My threshold was China, Russia and keeping our country safe," Trump reportedly said.

Prosecutor Kevin Wallace offered to refresh Trump's memory.

"And just to refresh your recollection, you were not president in 2021?" he asked.

"No I wasn't," Trump admitted.

Special counsel Jack Smith fired back at former President Donald Trump's motion to have his 2020 election subversion case dismissed.

Trump's legal team has argued that the former president cannot be charged with four counts of attempting to overturn the 2020 presidential election because he has free speech rights and was acquitted during a Senate impeachment trial.

But Smith knocked down those arguments in a motion filed on Monday.

"Rather than challenging the indictment on its merits, the defendant's motions... attack the indictment by mischaracterizing its allegations, raising inapposite hypotheticals, and advancing arguments that are long on rhetoric but short on law. Stripped of those distractions, the defendant's statutory and constitutional claims are entirely meritless," the motion stated. "The detailed allegations in the 45-page indictment are more than adequate to charge that the defendant conspired to defeat a federal government function through deceit and dishonest means."

Smith noted that it does not matter if Trump believes he won the election.

"The allegations that the defendant sought to overturn the results of the 2020 presidential election by resorting to fraud, deceit, and corruption place his conduct well outside the protections afforded by the First Amendment and likewise put him fully on notice that his conduct was criminal and thus subject to prosecution," the filing said. "Finally, the defendant's prior acquittal in a Senate trial following his impeachment in the House does not foreclose this criminal prosecution, and his particular reliance on the Double Jeopardy Clause is frivolous. The Court should deny the defendant's motions."
